Terms of Service

These terms govern your use of HolidayTexts.com, including our SMS/MMS messaging program. By using the service, you agree to them.
1. Acceptance of terms
By creating an account or using HolidayTexts.com, you agree to these Terms of Service and our . If you don't agree, please don't use the service.
2. Eligibility & parental responsibility
You must be at least 18 years old and the parent or legal guardian (or an authorized adult) to create an account. You are responsible for setting up and supervising your child's experience, for the information you provide, and for all activity under your account. You confirm you are the account holder or authorized user of any phone number you enroll.
3. What HolidayTexts provides
HolidayTexts delivers personalized, two-way messages from fictional holiday characters by text, email, and (coming soon) postal mail. Replies are crafted in each character's voice from the details a parent provides, generated and curated to feel magical and personal, and — when review mode is on — shown to the parent before the child sees them. Parents can review, approve, pause, and manage every conversation.
4. SMS/MMS messaging program
By enabling text messaging you agree to the following program terms. Message and data rates may apply. Message frequency varies. Reply STOP to cancel, HELP for help.
- Program description. HolidayTexts.com is a parent-authorized, two-way messaging program that delivers personalized SMS (text) and MMS (picture/multimedia) messages from holiday characters (e.g., Santa, Rudolph, the Easter Bunny) to a child under the supervision of the enrolling parent or guardian.
- How to opt in. The account-holding parent or guardian opts in during signup by providing the mobile number and agreeing to these terms. By opting in you confirm you are the account holder or authorized user of that number and are 18 or older.
- Message frequency. Message frequency varies based on the characters, channels, and settings you choose (for example, seasonal check-ins and replies you request). Recurring messages may be sent.
- Cost. Message and data rates may apply. HolidayTexts does not charge for the messages themselves, but your mobile carrier's standard message and data rates apply per your plan.
- MMS specifics. Some messages are MMS and may include images or other media. If your device or plan does not support MMS, you may instead receive an SMS, possibly with a link to view the content.
- HELP. For help, text HELP to 00000, or email support@holidaytexts.com.
- STOP / opt-out. To cancel at any time, text STOP to 00000. You will receive one final confirmation message and then no further messages to that number. You can also manage or pause messaging from your parent dashboard.
- Carriers. Supported carriers include major U.S. carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier's transmission and is not guaranteed.
- Privacy of opt-in data. Mobile opt-in information and consent are never shared with third parties or affiliates for their own marketing purposes, and we do not sell this information. See our Privacy Policy for details.
5. Acceptable use
- Use the service only for its intended, family-friendly purpose.
- Don't submit unlawful, harmful, or abusive content, or content about anyone without the right to share it.
- Don't attempt to disrupt, reverse engineer, or misuse the service.
6. Subscriptions, billing & cancellation
Paid plans (such as the Season Pass and All-Year Family plan) are billed at the price shown at checkout. Subscriptions may renew automatically for the same term unless cancelled before the renewal date. You can cancel anytime from your parent dashboard; cancellation stops future charges and takes effect at the end of the current term. Fees are non-refundable except where required by law. 7. Intellectual property
The HolidayTexts name, logo, characters, artwork, and content are owned by HolidayTexts or its licensors and may not be copied or used without permission. You keep ownership of the details you provide and grant us a limited license to use them to operate the service.
8. The “magic” disclaimer
HolidayTexts characters are fictional and provided for entertainment and family enjoyment. Messages are generated and curated by HolidayTexts and are not actual communications from any real person or entity.
9. Disclaimers & limitation of liability
The service is provided “as is” without warranties of any kind. We don't guarantee uninterrupted or error-free delivery, and carriers are not liable for delayed or undelivered messages. To the maximum extent permitted by law, HolidayTexts is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.
10. Changes to these terms
We may update these terms from time to time. We'll post the new effective date here and, for material changes, notify the account-holding parent. Continued use after changes means you accept them.
11. Governing law
